No decision was reached by the cabinet that afternoon. Lord Aberdeen’s memo was before them, as was the Colonial Office’s reply to the cable that had been sent to London: ‘As Privy-Council tender no advice, you must decide according to your own judgment.’ The Colonial Office’s confidential file on the matter reveals that Joseph Chamberlain and his officials had no difficulty in coming to this decision.13 The colonial secretary noted on the file, his officials agreeing with him:

The instructions enjoin that our said Governor General shall not pardon or reprieve any such offender without first receiving in capital cases the advice of the Privy Council of our said Dominion.

The receipt of such advice is not necessary to the validity of the Governor General’s action and the clause is intended to ensure there is a voice in the matter if they choose, and as they refuse to advise him he must simply use his own discretion.
