Nederlander fiercely opposed the special demolition permits proposed by the planning commission, which would’ve set up a restrictive process before any of the 44 theaters could be destroyed. Nederlander wanted the owners to have maximum flexibility to do with their theaters as they would—from air-rights sale to demolition. He argued that his organization financed their shows by borrowing against individual theaters. If banks couldn’t demolish, they wouldn’t loan, he said. Council president Carol Bellamy, supported by Stein, forced a change in the planning commission’s proposal and put a sunset provision on the new zoning regulations of one year.

Nederlander and other owners were named to a Theatre District Advisory Council, which is still preparing new regulations to govern development issues there. One city official recalled that Stein repeatedly pressed the Koch administration to deal with Nederlander’s “problems.” After the changes he favored were amended to the new zoning code, Nederlander kicked in another $11,790 to Stein’s committee in September 1982. Stein withdrew $32,500 as a loan repayment the same month. In March 1983, on the first anniversary of his initial contribution to Stein and shortly before the sunset provisions expired, Nederlander gave another $5,000. The committee repaid Stein $35,000 that month.
