The new legal framework has at times been a useful tool in civil society’s activities against the privatization of basic services. The level of interest, organization and capacity-building of social movements, at the local and national level, has been crucial in defining how infrastructure policies are run. Decentralization as established by the new Constitution is another important element.

Federal, state and municipal governments share responsibilities for health, housing, transport and water. The Constitution establishes that local services - including water - are regulated at the federal level while being run by the municipalities, and that health services are the common responsibility of the federal, state and municipal governments. The federal government regulates urban and housing policy and in the state of São Paulo, housing policy is decided on at the state and municipal level. Public transportation is run by the municipality (municipal buses) and by the state of São Paulo (the underground).
