A Distinction with a Difference

Privacy advocates often use terms like “dragnet” and “mass surveillance” to condemn government surveillance programs but not always with much rigorous analysis behind them. In understanding the scope of US intelligence electronic surveillance programs over the past twenty years, as well as the likely future directions of border patrol and law enforcement agencies, it’s useful to look at what “bulk interception” really means, and why—even within large-scale data collection programs—there are meaningful differences in the ways that mass surveillance and bulk interception can impact individual privacy. The topic is particularly timely in light of the US Supreme Court’s 2018 decision in Carpenter v. United States,1 which places limits on the government’s ability to gather customers’ location data from mobile phone companies—but which offers very little practical guidance for other metadata collection programs in the future.
