Three months later
July 12, 2010
ERIN LEANED CLOSE TO THE BARS OF THE HOLDING CELL AND SPOKE softly to avoid being overheard. Bader had just granted the stateâs motion to bar the recordings involving the stop of Swish, and Erin was surprised by how unnerved Jon appeared by her decision. âDonât worry. Remember this is what I told you we were expecting to happen. Our goal is to try and get into evidence the recording of Britton and Smith. This was just setting the stage for that.â
âOkay,â Jon said, sounding unconvinced.
She was worried about him. Over the last few months, he had lost a lot of weight and his skin had a milky pallor, the result of not being outside for eight months.
âWeâre in the home stretch, Jon. Less than two months to trial,â she said in an effort to offer him some hope. âHang in there,â she said, knowing full well that for him the trial held the possibility of either redemption or damnation. âHave faith things are going to work out.â
His eyes betrayed a sadness that seemed to transcend his current situation. âI lost my faith a long time ago,â Jon replied.
She sensed his response was metaphoric, but it provided a segue into something she needed to ask. âYou told me that Gabe spoke to a lawyer. Assuming you testify, have you given any more thought to how you will respond if youâre asked about your relationship with him?â
âNothingâs changed,â Jon offered with a rueful grin. âHeâs promised he wonât hurt me.â He held up his hand and shook his head before she could say anything. âI know,â he said. âYouâve warned me. I get caught in a lie . . .â He didnât finish the sentence. âI understand, Erin. I understand. But I have to trust him.â
As she walked back into the courtroom, she found herself drawn back to the memories of her own incarceration and the impotence of knowing that, in large part, your fate rested in the hands of others. The one difference, she thought, was that Jon did have some control over his own fateâhe just needed to tell the truthâdespite that she was pretty sure he wouldnât.

âKind of what we figured,â Erin said to Swish when she returned from the argument on the motion. âBader made easy work of our relevancy argument. But we got what we set out to do; Baderâs seen and heard the recordings.â
âGood,â Swish said.
âLetâs hope,â she replied. âUm, I need to talk to you about something else.â
âSure, whatâs up?â Swish asked.
âRemember I told you back in January that Mark and I were talking about having a baby?â
âHow could I forget?â he replied, with a wink.
âWell, since then, we went ahead with the process and . . . and Liz is three and a half months pregnant. Mark and I are going to have a baby!â she said, her excitement tempered by her trepidations about how Swish would react.
Slowly the corners of Swishâs mouth started to curl, and the smile that started there didnât stop until it lit up his face.
