Dear Sir,
On December 4 of this year my wife and I were heading home to Alaska from California where weâd been on vacation. I was driving my pickup and towing a 34-foot travel trailer. We were on Hwy. 97 just past the town of Blue Spruce and heading into the mountains. There was a steady snowfall, not exactly a blizzard but we definitely wanted to get through the pass before dark.
A row of semis was pulled to the side of the road and drivers were putting chains on. I believe one of these was blocking the chains required sign I was later told was there. I did not see the sign.
I was pulled over and the officer told me he would have to give me a ticket for ignoring the sign. I started to explain that the sign was hidden by the trucks but then decided why argue. I told him to go ahead and write the ticket. I was in a good mood and nothing was going to change it.
He then asked me why I was in a good mood and whether Iâd been drinking. Dumbfounded, I told him that yes, Iâd had two glasses of wine with an early lunch but that was several hours ago. He informed me that he would require me to take a breathalyzer. I said I would, though I was not happy about it.
It then turned out the breathalyzer didnât work. He called on his radio and a short time later another patrol car, this time with two officers, arrived. They did not have a breathalyzer but were asked to escort me back to the jail in Blue Spruce where the test could be administered. I was shocked and angry. I offered to do a field sobriety test but was told that because of the bad weather they wouldnât be able to judge it accurately.
The officers took me into town, leaving my wife stuck on the side of the road in below zero weather to keep an eye on our property. I was taken to the county jail and took a breathalyzer test there. When I was done I asked for a ride back to my vehicle but they said they were shorthanded and couldnât spare a car. They suggested I take a taxi which I did, at my own expense.
When I got to Alaska I contacted an attorney and found out that although I was not charged with a crime the DUI arrest is on my record. I am requesting, no demanding, that you expunge that arrest from my record. It is not fair and I want it fixed immediately.
