By August 29, nearly a month after the deadline Parker had set, the Germans still had not filed all of their new evidence. Von Lewinski claimed that he couldn’t supply the government documents Parker ordered, so he filed affidavits from random government officials from that era instead. Bonynge was on vacation. Anderson was on vacation. Parker had just come back from a stretch in Maine. And von Lewinski was away. Meanwhile, Martin had postponed his trip to the Maryland shore to finish his brief by September 15. He was nearly done and did not look forward to writing a new one once von Lewinski submitted whatever evidence remained.

Martin ran into Parker at the State Department that afternoon. The umpire did not look well. His face was red from the heat, and he looked tired, despite having just come back from vacation. During their brief conversation, Parker told Martin that the climate in Maine, even during the summer, had been cold.

In the three days he’d been back, Parker had been at his MCC office early every morning, poring over the briefs that had piled up on his desk. Martin was glad to hear that he was working and requested a meeting with him the next morning to discuss the sabotage cases.

Martin always spoke in a measured and respectful tone, no matter whom he was talking to. But his voice during his meeting with Parker was tight with frustration. He told Parker that the Germans had put him in a difficult position. Von Lewinski was filing evidence that had nothing to do with any of the arguments made that April. Already Martin had seen new alibis for Jahnke and Witzke, stories whose veracity he hadn’t had the time or the resources to investigate. One of the German motions was actually missing three pages from the middle, making it impossible to respond to or research independently. Martin’s voice rose with each complaint, making it clear he didn’t appreciate the fact that Parker had given the Germans such latitude without recognizing the efforts Martin had made to honor the deadline.

Parker did his best to soothe the panicked lawyer. He even tried to call von Lewinski while Martin was still in his office. It was a Friday morning, and Parker was told that von Lewinski was taking a long weekend and wouldn’t be available until Monday. Martin did his best to contain his rage. His voice still taut, he argued that it was unfair that he should have to write two or three more briefs based on evidence submitted past the commission’s deadline. Parker tried to assuage Martin by telling him that wouldn’t be the case, but Martin cut him off, saying, “I cannot help but feel that the Commission will not deny the German agent the right to file this new evidence and that if it is filed it would require considerable time on our part to discuss it.”

The judge dismissed Martin’s disrespectful tone and instead tried to defuse the situation with a joke about his health.
