The case had caused a sensation. It is very likely that many, if not most, of the people who were in court to hear all the evidence that was presented believed that Monson had killed his young charge, in all probability with the help of the elusive Scott, but in the end the case for the defence had won the day. The jury returned with a verdict of ‘not proven’.

The verdict of not proven is unique to Scots law and is unpopular with many solicitors and advocates. It leaves a lingering doubt in the air: the innocent have not been declared innocent and the guilty may go free. Monson walked free, but the doubt lingers still, long after his death.

The firm of solicitors who represented Monson when he went for trial, Davidson and Syme, used to have their offices in a building in Edinburgh’s Charlotte Square. The building is now the headquarters of the National Trust for Scotland. Two small but significant items have been donated to the Trust to display in the building: a gold cigar-cutter and a silver pocket watch. These were given to his solicitors by Monson as security for his legal costs; they remained undisturbed in the firm’s safe for many years. Now they will go on show as interesting curiosities; another of Monson’s many unpaid debts and a testament to the sheer nerve of the man.
