George was unfamiliar with such a cold and stark environment, as his had been a life of privilege and wealth.

Unbeknownst to George, John occupied the cell next to him. It was in this environment they would live together and possibly die together.

April 29, 1902, Melbourne Supreme Court

The Public Prosecutor decided to try both defendants at the same time as after all the charges were the same. John and George were taken from their cells and as they left their miserable accommodation they were able to see each other for the first time in many months. They were instructed by the guards not to communicate but a nod of the head meant everything to the old friends.

The trip to the Supreme Court building took fifteen minutes. Both accused had handcuffs and leg irons fitted making it difficult to climb the steps to the dock.

This was to be a preliminary hearing where the judge would hear the prosecutor’s evidence against the accused and then decide if they should go to trial. The hearing took four hours and the judge had no hesitation in committing the two men to a trial on May 30, 1902.
