Transcript from the 9th Court Hearing on December 28th 2011 at Dubai Court.

The court scribe calls both defendants and confirms their presence. The Judge then asks the defense lawyers if there are any witnesses here to state today and how many there are. Dr. Eugen’s lawyer answers that there are three witnesses here today, asks them to come to the witness stand and introduces them to the Judge. They are Dr. Numairy, Dr. Ajimsha and Ms. Healey. First, Dr. Numairy is questioned while the other two witnesses have to wait outside the court room. Dr. Numairy is sworn in and the Judge starts his interview asking him what he wants to state. All the questions are asked by the Judge exclusively and Dr. Numairy answers as follows:

“There has not been any personal relationship between me and Dr. Eugen before I contacted him officially at the beginning of the investigation which the Higher Committee was asked to perform on the death of a patient. In order to investigate we requested all pertinent documentation from the hospital and we interviewed three doctors, Dr. Yasser Masri, Dr. Isamil Ajimsha and Dr. Hassan Fouad as well as Nurse Amin Nagi. These interviews were performed at the hospital. Furthermore the committee consulted independent specialists in the field of Intensive Care Medicine. Based on all this information a final report was generated. We concluded that Dr. Eugen does not bear any responsibility and that Dr. Obeid breached his medical duties. Doctors’ orders are only to be followed when they are put down in writing. “

The Judge then asks the witness Dr. Numairy if they interviewed all the doctors he just named.

“Yes we did,” Dr. Numairy answers “and all of them stated that they did not hear any order from Dr. Eugen not to resuscitate the patient in case of a cardiac arrest.”

“But” the Judge interjects “Dr. Yasser stated before that Dr. Eugen gave such an order”.

Dr. Numairy clarifies “Dr. Yasser was not present at the time in question and, in front of the committee, he declared never to have heard this alleged order”.

“Where is it written down that such an order has to be in writing?” the Judge now wants to know and Dr. Numairy explains “There is a corresponding policy at Rashid Hospital. Exceptions from this policy only are allowed when there is no time to write down the order in emergency situations, but even then the order has to be put in writing as soon as the emergency situation is over. In our case there was absolutely no emergency situation two days before the patient’s death when the order allegedly was given”.

“And,” asks the Judge “may the doctors request their superiors to put an order in writing”.

“Yes they may and even have to.” Dr. Numairy replies.

“And how would you comment that an order from Dr. Eugen not to resuscitate was heard?” the Judge inquires and Dr. Numairy resolutely denies “Not one of those who we interviewed said to have heard such an order”.
