During direct examination of Nassau County Detective Charles Hildebrandt, prosecutors dramatically brandished the blood-stained Ballpein hammer that had been recovered from a toolbox in Ray’s car after his arrest. Detective Hildebrandt testified that while Martha was being held in Michigan, she identified the hammer as belonging to Ray and while she could not say for sure that it was the actual murder weapon, she did confirm that it was “like the one” used to kill Janet Fay. Although Martha and Ray had displayed confident smiles for most of the day, the appearance of the hammer noticeably darkened their mood.

Later, during cross examination of Detective John Vander Band, defense attorney Rosenberg sought to show the jury that the confessions given by Ray and Martha had been effectively coerced.

“Prior to the supplemental statement given by Mrs. Beck on March 11, did she ever comment that you were trying to bully her?”

“I can’t recall sir,” the detective replied curtly. “But it’s not my policy to offend anyone.”

“Did Mr. Fernandez ever say to you: ‘Let me alone. I’ll say anything you want. I’ve had no sleep?’”

“No,” Vander Band insisted, while admitting that Ray had “said he was tired several times during the investigation.”

The jury seemed bored for much of the cross-examination, as Vander Band blandly responded to most of Rosenberg’s questions with “I don’t recall” or “I can’t recall that.” However, the detective conceded that Ray told him he would back Martha “100 per cent because he loved her,” an acknowledgement Rosenberg hoped would sway the jury into believing Ray’s contention that he had lied in his confessions.
