Paul Hayes almost lost his life in the Fort Stockton shootout.

The former Mrs. Smith appeared at police headquarters a day after the shootout. Alleging a police conspiracy to deprive her of property, the gunman’s ex-wife demanded Chief Patrick provide her with her former husband’s car.

Mrs. Smith wasn’t the only issue.

Outraged at the damage done to their home, the Showley family filed a damage claim with the City of San Diego. Citing a lack of bullet insurance and a reckless disregard for their personal property, the family requested the city reimburse them for the $5,000 worth of repairs needed to their home. To justify his claim, Mr. Showley rhetorically asked the media, “Suppose there was a fire in your home and the fireman’s hose did more water damage than the fire ever could have. Wouldn’t you be entitled to compensation?”

The city didn’t buy the argument. The claim was flatly denied. Deputy City Attorney F.M. Downer told the press, “This claim is without merit. If we were to pay people every time an officer damages something in the performance of their duty, police would soon stop doing their duty out of fear.”

The acting mayor, Councilman Louis Maire, backed up the city attorney. “I cannot think of this as a financial matter,” Maire declared. “I believe the lives of the Showley family were saved by our policemen. The payment of any damages would establish a danger[ous] precedent that we must not do.”
