The jury was brought back in and Brown continued his questioning of the witness.

Brown: Did you know, ma’am, that Andrew Schwarz had been in counseling since he was three or four years old?

Idrissi: Yes, I did.

Brown: And that Andrew Schwarz was approximately four years old before he was ever able to talk?

Idrissi: I did not know that, no.

That afternoon—after Mrs. Idrissi’s testimony and the lunch break—Judge Colbath made a statement to the jury regarding Andrew’s “broken nose.”

He explained the following: “The state and the defense have reduced their earlier stipulation to writing and it definitely goes a little bit beyond what I’ve already instructed and I think it’s very appropriate that I read it to you precisely as they have agreed to it because it’s a little more far-reaching and sweeping than what I instructed you to and it is as follows: ‘There’s no medical evidence known to the state or to the defense that Andrew Schwarz ever had a broken nose.’”
