The Home Secretary’s reply was sent on 17 April, just two days before the planned execution date, and held out little hope for the condemned:

Sir – Mr Secretary Cross having carefully considered your application on behalf of Alfred Thomas Heap, I am directed to express to you his regret that there is no sufficient ground to justify him, consistently with his public duty, in advising Her Majesty to comply with the prayer thereof, - I am sir, your obedient servant.

Also on Saturday, the scaffold was erected in its traditional location, the north-east corner of the gaol yard. On the following day, Sunday, 18 March, during the late afternoon, William Marwood the executioner arrived at the gaol.

On the Sunday, Heap attended two services, and at one of them he asked the prison chaplain, Reverend O F Piggott to address the other prisoners on his behalf, with the following:

It is the last day I shall be amongst you, and it will be a benefit to some to say that through true repentance and faith in Jesus I have made my peace with God, though the Devil causes me terror at times. Drink has been the cause of my committing many of these sins, which otherwise would not have been committed. I hope you will take warning.
