Proving that you almost certainly don’t, look what happened to thousands of people who downloaded purchases on April 1, 2010, from Gamestation, a British computer game retailer. The company revealed that its ToS agreement contained a clause giving the company legal rights to their souls. “By placing an order via this Web site on the first day of the fourth month of the year 2010 Anno Domini, you agree to grant Us a non transferable option to claim, for now and for ever more, your immortal soul. Should We wish to exercise this option, you agree to surrender your immortal soul, and any claim you may have on it, within 5 (five) working days of receiving written notification from gamesation.co.uk or one of its duly authorised minions.” It was an April Fool’s Day joke, but it proved that few people read ToS agreements. (Customers had the opportunity to nullify the clause—and get a £5 voucher for doing so—but only 12% did, suggesting that the other 88% didn’t read the ToS. And even if you do read every ToS, what are you going to do if you disagree? It’s not as though Apple will be willing to modify your ToS when you buy an iPhone.
