Enforcement from State to State

Several states now have laws that include criminal consequences for bullying, although the requirements and sanctions vary significantly. Some require schools to report any bullying acts that may constitute unlawful behavior to law enforcement; others outline ways to determine when bullying acts should be reported to law enforcement. Missouri laws stipulate legal repercussions for school staff who don’t comply with that state’s reporting requirements if bullying behavior constitutes criminal activity.

In Texas, disruption of class is a class C misdemeanor; in Delaware, the bullying law states “harassment, which is any attempt to harass, annoy, or alarm another person, is a class B misdemeanor offense.” When states have their own antidiscrimination laws (separate from federal laws), such as in New Jersey, school districts can be held accountable for failing to uphold those laws and allowing discrimination-based bullying to take place in school.
