It was at this hearing on April 22 inside Dzhokhar’s heavily guarded room at Beth Israel that he would meet his death penalty defense team for the first time. Two FBI agents had grilled him again that morning before federal public defenders Miriam Conrad, William Fick, and Timothy Watkins came to his room to protect their client’s rights. It was only then that he was read his Miranda rights. Assistant US Attorneys William Weinreb and Aloke Chakravarty represented the government in the crowded room. Judge Marianne B. Bowler, a US magistrate, oversaw the proceedings.
She started by reciting the date for the court clerk: “Today is Monday, April 22, 2013. The case of U.S. v. Tsarnaev will now be heard. Will counsel please identify themselves for the record?”5
“Good morning, your Honor. William Weinreb and Al Chakravarty for the United States.”
“Miriam Conrad with Tim Watkins and Bill Fick from the Federal Public Defender’s Office.”
“Thank you very much,” answered Bowler.
An attorney who introduced himself to the court as Jamie Katz, general counsel for Beth Israel Deaconess Medical Center, represented the hospital.
“For the benefit of counsel and for the physician, I have called this conference because I want to establish before we conduct the initial appearance the mental state of the defendant,” Bowler said. Then she turned to Stephen Odom, one of Dzhokhar’s surgeons. “So, Doctor, I am going to have a few questions for you.
“Please take your time and be relaxed about this.”
“Yes, your Honor,” Odom said.
“I will ask you to state your name, spelling your last name for the record.”
“Stephen Ray Odom, O-D-O-M.”
“And what is your occupation?”
“I’m a trauma surgeon.”
“Can you give me a brief summary of your professional education, training, and credentials?”
“I went to medical school at Texas Tech University in Lubbock, Texas. I did a general surgery residency at Stamford, Connecticut. And I did a trauma/critical care fellowship at Beth Israel Deaconess Medical Center in Boston.”
“Are you Board Certified, Doctor?”
“I am, in general surgery and critical care.”
“Thank you. Do you have any publications? Can you give us a summary of the area you have published in?”
“Mostly in emergency general surgery and traumatic illness.”
“And you are currently an attending physician here at Beth Israel?”
“I am.”
“What has your role been in the care of the defendant, Mr. Tsarnaev?”
“I was the attending trauma surgeon on call when he presented to the hospital, and I have subsequently been his attending during the duration of his stay.”
“What is his medical state at the present time?”
“Guarded.”
“Can you define what you mean by that?”
“He has multiple serious injuries that require ongoing inpatient medical care at this time. He is currently in an intensive care unit, though his status is not critical.”
“Can you give me a brief summary of his injuries?”
“He has multiple gunshot wounds, the most severe of which appears to have entered through the left side inside of his mouth and exited the left face, lower face. This was a high-powered injury that has resulted in skull-base fracture, with injuries to the middle ear, the skull
