Dynamisierung und Dekonstruktion von Meisterschaft in den gelehrten Kulturen des 16. bis 18.Jahrhunderts am Beispiel Polens
von Maria Filipiak
The pan-European rediscovery and reception of Roman law and the evolution of its perception since the late eleventh century led to the emergence of a new type of legal expert. As a result of the changes in the approach towards the interpretation of law and the definition of legal knowledge learned jurists of the Renaissance became established intellectual leaders. These new experts, combining higher legal education and practical experience, exposed and denounced specialists of the time as unlearned practitioners. One of the main critics was BartÅomiej Groicki, a sixteenth century Polish jurist who pioneered the polonisation of legal practice. Groicki did not just condemn the lack of qualifications and greed of contemporary legal practitioners â he also became one of the first European jurists to criticize the use of torture and death penalties in criminal proceedings. The same phenomenon can be observed during the eighteenth century and the Polish Enlightenment, when the satires of Ignacy Krasicki exposed the loss of moral integrity and the corruption of traditional virtues among the Dominican and Carmelite orders. This article focuses on the various strategies of self-staging employed by the investigated groups of experts, including the methods used by their critics to uncover those strategies and their attempts to deprive them of their performative magic.
