Q Over the next month, while Norm Maleng considered our offer, our side continued to move forward, just as if we were going to trial. For all we knew, Tony was right—Norm would say no.

We did not talk of Plan B to the other members of the team; it was too risky. The more people who knew, the greater the chance of a leak. The very worst thing that could happen now was for these discussions to be made public. It would destroy any remnant of the possibility of an unbiased jury. So we maintained our façade, essentially lying to our overworked and underpaid investigators and paralegals.

I continued seeing Gary, Monday through Friday, for anywhere from two to five hours, trying to keep his brain focused on the horrible events from twenty years past. I soon learned that, as with faces, he had no knowledge of the victims’ names. He said the names meant nothing to him, because most of the women and girls he dated used fake names. That was one possible explanation. Another was that Gary was a psychopath, who didn’t think of his victims as people but rather property, even trash, that he could dispose of at will. He only knew the names of a few, and those only from what he had seen, read, or heard about the case, before and since his arrest.

Q

These grim discussions continued through our meeting with Maleng and for several weeks afterward, all the way into late May. About once a week or so, I was joined by Michele. Despite our earlier disagreement, Michele and I managed to be cordial and professional during these sessions with Gary. He had previously sensed our friction, so Gary was happy to see Michele. We went over everything we could think of, and then we went over it again. And again. After the flood of information rushed out, smaller bits continued to float to the surface.

After we had talked and talked about the factual things, we eventually discussed his understandings of the other major questions: Why? Why did he start? Why did he come to enjoy killing young women? And—how did he stop?

Gary’s answers to the “why?” question were superficial at best, but it gave some insight into what he’d been thinking at the time.

One morning in early May, I asked him, point-blank, “Why did you kill these women?”

Gary replied, “I was just so mad at Marcia. She treated me bad during the divorce. I just wanted to kill her.”

“But you didn’t kill Marcia,” I said, but it was more like a question.

“If I had killed Marcia, I would have been the number-one suspect.

I guess I just hated all women.”

“So why prostitutes?”

“Well, I hated them if all they worried about was their money and time. Like, ‘hurry up. I gotta get back.’ That kinda stuff.” He looked at me, nodding. “You know . . . that would kind of set me off into a rage.

Those were the ones I killed.
