After the Fact

One morning as you are opening, local law officials stop by with news of an incident that happened to a possible customer of your bar last evening. As part of the investigation, especially if a breathalyzer test showed alcohol or intoxication, they are interviewing all the bars that the person visited. At this point, especially if you have not looked at the logs yet, request that the interview take place with your lawyer present. Legally, you may be entitled to some basic information, including the name(s) of the victim(s), and the details of what happened.

After they leave, you need to call your lawyer and follow their advice. However, one warning: if in the course of the investigation you discover that one of your employees did not follow your written policies, then that person needs to be terminated immediately to help mitigate your legal liability.
