Olympic Rules on Doping
In 1999, in an IOC-led movement, the World Anti-Doping Agency was formed. The 2007 Olympic Charter clearly bans PEDs. Rule 44 asserts that the World Anti-Doping Code is mandatory for the whole Olympic movement. The introduction to the World Anti-Doping Code asserts that the purpose of the code is: “To protect the Athletes’ fundamental right to participate in doping-free sport and thus promote health, fairness, and equality for athletes worldwide. . . . Doping is fundamentally contrary to the spirit of sport.” In Article 1, “doping” is defined as “the occurrence of one or more of the doping rule violations [set forth in other parts of the Code].”
Article 4.3 sets out the criteria for inclusion in the code, which is that a drug must meet two of the following three criteria: there is evidence that it has the potential to enhance or enhances sport performance; there is evidence that it poses a potential or actual risk to the athlete; or the drug use or its method of use violates the spirit of sport. It violates the spirit of sport if it conflicts with the value of excellence in performance, ethics, fair play, honesty, dedication and commitment, and so on. A drug or method can also be banned if it masks or has the potential to mask the use of a prohibited drug. Article 4.4 allows athletes with documented evidence of medical conditions that require the use of a prohibited drug to use it for therapeutic purposes as long as certain evidentiary conditions are met.
