Answer: “I wasn’t taking any chances of being knocked over the side.”

McKenzie admitted that he had a thirty-eight-calibre revolver in a holster and that no one had tried to take it from him. He had placed it under a mattress as they neared St. Pierre. He saw no other firearms aboard Kromhout.

Question: “You made no effort to take charge of the vessel?”

Answer: “Not after he told me to get away, and jumped and kicked like an old fool.”

McKenzie told the court he had been given good treatment on the Kromhout.

In explanation of why he had sought to hide his revolver under a mattress, McKenzie said he had never been in St. Pierre and didn’t know if one was allowed to carry firearms. Answering a further question by Mr. Daley as to why he failed to use his revolver, McKenzie answered that “it would give people more chance to talk about the brutality of the RCMP with guns.”

After a heated debate with the defence counsel, Mr. Daley told the court he would proceed under Section 207 of the Customs Act, relating to hovering in territorial waters with a contraband cargo.

The following day Captain Hyson was on the stand, giving evidence similar to that of Mr. McKenzie. He was questioned by Mr. Potter.

Potter: “Can you indicate any offence this vessel had committed, or you suspected she had committed, when you attempted to bring her in?”
