State Sheriff Bruce Barnes and lawyers from the attorney’s general office investigated the incident. Verne West, a thirty-one-year-old Kimball truck driver, was soon arrested on a charge of manslaughter. A.D. Brooks of Pukwana, floor manager at the dance, testified that he had asked West after the mêlée who had hit the sheriff, and West said he did, although at the time West was not aware the man was the county sheriff. On September 8, three days after the incident and after Sheriff Miller had been buried in Kimball’s Pleasant Grove Cemetery, Brule County state’s attorney H.V. Melcher ordered an autopsy. The body was exhumed and an autopsy conducted by Dr. E.W. Jones of Mitchell, Dr. J.L. Bettag of Pukwana and Dr. O. Charles Erickson of Sioux Falls. They determined death had not resulted from a blow to the head but was caused by a heart attack from artery hardening. The accused assailant was released.

As an aftermath of the death of the state’s oldest sheriff, his son, I.K. Miller, was appointed by the Brule County Commission to succeed his father. At twenty-six, he became South Dakota’s youngest county sheriff. In the 1932 general election, young Sheriff Miller was elected by a larger plurality than his father had garnered in the 1930 election. In fact, the Brule County turnout was the largest to date by more than four hundred votes, an indication of voters’ respect for the deceased Clarendon Miller and his son.
