D efense Attorney Herbert C. Joyner began by addressing the court and describing the scene the morning of the tragedy. Joyner stated, “We do not know, and the government does not know, that it was the defendant’s gun which shot his sister.” He suggested that robbery or revenge was the motive of the burglars and that they intended to steal “anything they could lay their hands on.” He went on to describe them as “young, active and slight men, else they could not have gotten out of the house through the opening left in the screen.” He said men were seen running down Benedict Road at the time of the crime and suggested that the burglars simply blended in with the gathering crowd and escaped in the confusion.
Attorney Joyner related that many “non-English speaking” employees of the R.L. Fosburgh and Son Construction Company were paid in cash at the company office. These men were aware that large sums of money were transported from the bank to the office. He claimed that Pittsfield police chief Nicholson himself remarked that “if any men needed a pistol, the Fosburghs did.” Attorney Joyner stated that this is why Robert S. Fosburgh purchased one.
He related that Robert S. Fosburgh and his wife, Amy, had first occupied the kitchen-bedroom but moved to another room due to an odor in the sink. They left some clothing and Robert’s pistol in the bureau.
Attorney Joyner stated that the family had thrown clothing, pillowcases and other items into a basket located in the carriage house. He went on to explain that the furniture in the home was cheaply made and easily broken by the struggle in the back room. There was a narrow opening between the bed and the bureau, which he suggested was moved around during the struggle.
