Most significant, however, is the construction of the immigration system in the United States as a way to keep in desirables and to keep out undesirables. The concept of “desirables” in the immigration context is parallel to that of U.S. society in general. People of color, low-income people, lesbian, gay, bisexual people, and transgender people . . . are marginalized in our society whether or not they are immigrants. Thus it logically follows that those immigrants who are already marginalized . . . in our society are further marginalized. This dynamic has proven to be especially powerful during times of “heightened national security.”
