Alexander and his heirs were to hold and possess these lands

with demesne-lands, homages, rents, services and all rights and pertinents of the said islands, without retention, along with the right of patronage of the bishopric of Man,

saving any rights held in the bishopric by the church of Nidaros, and specifically excluding the islands of Orkney and Shetland, ‘which the said king of Norway has reserved specially to his domain’. It is further stated unequivocally that all of the inhabitants of the ceded islands, ‘as well lesser as greater’ (tam minores quam maiores), were henceforth to be subject to the laws and customs of the kingdom of Scotland. They would not be punished or disinherited on account of their activities while they were under allegiance to the king of Norway, but would ‘stand peacefully therein under the lordship of the king of Scots as other free men and lieges of the said lord king who are known to enjoy the most free justice’. Moreover, the inhabitants of the isles had the option either to remain there, and become subject to the king of Scots, or to leave:

if they wish to retire they may do so, with their goods, lawfully, freely and in full peace; so that they be not compelled either to remain or to retire contrary to the laws and customs of the realm of Scotland and their own will.
