Title IX

Title IX is part of the Education Amendments of 1972; it provides protection and prohibits discrimination on the basis of sex in any federally funded educational program. Varying political pressures between presidential administrations has made it so a federal definition of what sex means is still lacking, which leaves schools in a murky position. Regardless of definition, Title IX prohibits discrimination based on sex, including harassment, bullying, and sexual assault, and schools must protect students at school, on buses, and at school-related events. Writing for the National Federation of State High School Associations, Lee Green (2018) asserts:

Schools must have procedures in place consistent with Title IX for accepting reports of harassment or bullying of LGBTQ students, for investigating such complaints as required under Title IX, and for resolving such disputes using the same policies and procedures used in all complaints of harassment and bullying of students.

This means that districts are required to have district-level coordinators who oversee discipline policies and activities around sex-based harassment. Title IX also charges schools with implementing strategies that safeguard students from such behavior, whether perpetrated by school personnel or by peers, and effectively addressing misconduct when it occurs on campus or in connection with any educational or extracurricular program (Green, 2018). Depending on student voice in your school, you may closely collaborate with your district’s Title IX coordinator to help support victimized students with wraparound programming and services and to help school leaders address climate issues that perpetuate harassment.
