The Health Information Portability and Accountability Act, commonly referred to by the acronym HIPAA, was made law in 1996 by the U.S. Congress. The first title, or section, of the act protects workers from losing their health insurance if they change or lose their jobs. The second title covers matters of security of electronic medical records and patient confidentiality.

The U.S. office for Civil Rights (OCR) administers and enforces the second title’s privacy and security rules, as well as the confidentiality provisions of the act’s patient safety rule. Typically the OCR works with heath care facilities to fix any problems the latter has in meeting privacy and safety guidelines. In some instances, however, facilities that do not comply with the rules are subject to hefty fines. Each violation can incur a fine of $100 to $50,000 or more, depending on the situation and when the violation occurred. The fine limit for violations is $1.5 million.
