Interposition and the American Political Tradition

The idea of interposition or nullification became associated with disunion after the Civil War, and it has been widely considered a foolish, impractical, and unconstitutional concept. Undoubtedly the Civil War altered the premises of the argument: if America had ever been a voluntary union of equal states, then the war certainly altered that relationship. Furthermore, the Fourteenth Amendment, especially as interpreted during the twentieth century, clearly elevated the national government to the position of a superior, making the policy largely moot as a practical alternative. One may question, however, whether the fact that interposition was historically rejected means it lacked theoretical rigor. It is incumbent upon us, therefore, to assess Calhoun’s most famous teaching both theoretically and practically within his own context. Such an examination will show that its theoretical underpinning was based on a reasonable, though certainly not universal, understanding of American constitutional development, and while it was not without some practical difficulties, neither was it an entirely unworkable proposal for his own time.
