NOTE: The Commission found this reasoning to be consistent with the variables that were reviewed in the examination of the pertinent evidence.

It was also noted that Elvis told two people who can be found through research, that they weren't to worry, when they heard the news of his ‘death’. One person he talked with was his cousin Gene. To show how close Elvis and Gene were, here is some background information on their relationship. Gene Smith was born to Lavalle Smith, Gladys' sister, seven weeks before Elvis was born. Gene grew up with Elvis in Tupelo, Mississippi, where they played together, double dated, and also worked together at Precision Tools, in Memphis. Gene and Elvis were very close, and in fact was a member of the Memphis Mafia, (Elvis's entourage), until the late 1960's. Gene lived at Graceland, sometimes sleeping in the same room as Elvis, to prevent him from sleep walking. In Gene's words, ‘We were closer than brothers’. Gene also stated, regarding August 16, 1977, ‘I saw Elvis a few weeks before August 16th, and he (Elvis) told me, Gene I envy you. You can go anywhere. If you want to stop someplace for a beer, you can’. Gene continued on by saying ‘Elvis also told me, shortly before the sixteenth, that he would be going away for a while, but that he would contact me later’. When Gene heard Elvis had died, he said he couldn't believe it and felt something was wrong. He knew he was right when he went to the family viewing.

Another person that Elvis told not to worry was Ellen Foster, a close friend of his who strongly reminded him of his mother, Gladys. The conversation took place on August 14, 1977, two days before his ‘death’. Elvis phoned Ellen and, during the conversation, he told her that he wasn't going on the upcoming concert tour, nor was he cancelling it. He told her not to worry and not to believe what she reads. He also told her that all of his troubles were ending, and that he felt better than he had for a long time. It was interesting to note that Elvis loved these two people so much that he was concerned about them enough, to let them know not to worry.
