THE SEDITION ACT

Even speaking negatively about the United States became illegal with the Sedition Act of 1918. This law criminalized criticism of the government, military, or Constitution. Union leader Eugene Debs went to prison for his antiwar speeches. So did fellow socialist Charles Schenck. He distributed antiwar pamphlets that encouraged Americans to disobey the draft.

Schenck’s case reached the Supreme Court, which ruled against him. Justice Oliver Wendell Holmes defended the Sedition Act in 1919, saying that a person cannot yell “Fire!” in a crowded movie theater without cause. While it was not a part of the Court’s official ruling, this example boiled down to: When the country is at war, stop making trouble.
