Living with a partner may put your custody case at risk. Consider such a decision thoughtfully, taking into account the advice of your lawyer.

8.16 I’m gay and came out to my spouse when I filed for divorce. What impact will my sexual orientation have on my case for custody or parenting time?

None. There are no laws in Connecticut that limit your rights as a parent based upon your sexual orientation.

8.17 If I leave my home during the divorce, will it be considered abandonment?

Moving out of the marital home during your divorce in and of itself does not rise to the level of abandonment.

Abandonment is rarely an issue in custody litigation unless one parent has been absent from the child’s life for an extended period. Abandonment is determined by the facts and circumstances of each case. It must have occurred for a significant period of time and be without a just cause or excuse. The intentional absence of a parent’s presence, care, protection, and support are all considered.
