It’s not the FDA regulation alone that affects the selling, finding, and holding of turtles as pets. Each one of the fifty states can put the Turtle Police on patrol with laws that restrict the taking and keeping of any wildlife. And the laws are a hodgepodge. In Maryland, you may keep one box turtle and get a permit to have more than one from the Department of Natural Resources. State law also allows the possession of a turtle under four inches, but the DNR has not yet seen fit to honor the law. In New Jersey, you may keep a pet turtle if you get a permit and also provide proof that the turtle was not wild-caught in the state. Indiana forbids the taking of Eastern box turtles from the wild; if you should acquire one legally from another state, you must arrange to have it inspected by a veterinarian and get a Special Purpose Turtle Possession Permit (that’s the name that the Indiana Division of Fish and Wildlife came up with) before you may bring it home. Indiana also requires that you obtain a permit to keep a shell that no longer houses a box turtle, and it prohibits the breeding of captive turtles. To take snapping turtles—a legal act—you need a hunting license. Ohio allows you to take a turtle from the wild but stipulates that when its carapace reaches four inches a PIT—passive integrated transponder—microchip be implanted in the animal’s skin for identification. In Georgia, it’s unlawful, period, to keep any box turtle, no matter how you acquired it. Virginia, on the other hand, is liberal, requiring no permit but limiting the number that may be kept to five Eastern box turtles and five of any other species. All, however, must measure four or more inches.
