On the other end of the risk capital standard would be the purchase of an interest in a group investment with a specified piece of raw land to be held as a long-term investment as the real estate asset. It would be possible that a court could hold that if an investor in a group investment receives the full value of their investment through a share of the ownership in the entity that owns the land no capital is placed at risk at that time. While it is possible the investor could lose money, it might be argued the events that would cause the loss of money are considered to be marketplace risks, not security risks.
