Defendants with lawyer Clayton Ruby after acquittal, Feb. 14, 1979. Photo: Bill Loos The court exploded into cheers and applause that became a standing ovation as the three of us left the defendants’ table and were swept into the arms of jubilant supporters. I was giddy with delight. We’d won, and won decisively. The judge had described TBP as a “serious journal of news and opinion.” He read long sections of the article into the court record, including the entire preface and conclusion. He declared that “were ‘immorality’ the only offence alleged here, I would dismiss the charge without hesitation.” That was a decision so provocative that Ruby muttered to me, as we crossed Queen Street to the hotel where we’d arranged to hold a press conference, “The Crown is sure to appeal. There’s going to be an appeal.” He was right, of course; but, for the moment, we revelled in the bliss of it and were a little cocky with the media at the press conference and wildly exuberant with our supporters at a celebratory party that night at the gay bar Buddies, then at Church and Gerrard. The media followed us there, and I was described by them as indulging in “long, smoldering kisses,” and indeed I was, as many as I could get.
