Justice Matheson then summed up the case and warned the jury about the effect of their emotions on their decision – which was immediately illustrated by an emotional outburst by a young woman in the gallery who was then escorted from the court. He went back over the events of the case, giving a chronological account of each crime. When referring to the inconsistencies between the police record of interview and Miller’s version in his unsworn statement, Matheson pointed out that the police had given their evidence under oath, while the accused chose not to swear to the truth of his account, resulting in his immunity to cross-examination. The jury retired just before 1 p.m.
