• Provide a second heading on the next element or factor, and proceed accordingly until all the elements or factors are completely analyzed.

Headings might sound like an obvious writing task to complete, but headings in legal writing require thoughtful construction in substance and form. One- or two-word headings or sentence fragments are rather useless to a legal reader. Instead, the best types of headings are those that inform the reader about what part of the rule you will discuss next and, even more beneficial, concisely suggest how the part of the rule affects the client’s case. Effective headings usually occupy no more than three single-spaced lines of text and form a complete sentence. The reader should be able to grasp all the key points of the memorandum’s legal analysis simply by reading your headings.
