On this basis, one could draw the following conclusions: • the so-called ‘in-built cooperation s’, which the highest decision-making authorities of the Member States decided to insert in the treaties, and which concern major and clear political purposes, allow willing Member States to cooperate among themselves and to take decisions, within the framework of the EU institutions, without being obliged to have the agreement of the other Member States;

• the ‘enhanced cooperation s’, proposed in the treaties since 1999, but which remain to be decided on a case-by-case basis at the level of the EU institutions, have hardly ever been used. However, taking into account two recent cases, 56 could one hope that this might be a sufficient solution for the future? Unfortunately, this might not be the case, for the reasons given below.
