AFFIDAVIT

The undersigned, of lawful age, being duly sworn, upon oath deposes and states as follows:

1. Kyle Canida is a Stillwater Police Officer #42.

2. Kyle Canida has read certain official investigative reports and statements of witnesses regarding (the above named arrestee(s) and, from these statements, reports, and your affiant's own observation and knowledge, it appears as follows:

Adam Tyler Riggs was arrested at 111 N. Perkins on 12-4-05 at 0133 hours. He was arrested because:

On 12-4-05 at approximately 0119 hours I was dispatched to 111 N. Perkins, Wal-Mart. in reference to a Grand Larceny Shoplifting, Upon arrival I made contact with (W) McDaniel and (A) Riggs In the back office. It should be noted I observed McDaniel had various colors of magic marker all over his face and neck. He even had a penis drawn on the right side of his neck.

I asked what happened and McDaniel stated he watched Riggs load a bunch of CD's and DVD's into his cart and put them in Wal-Mart bags. He stated then tied the tops closed and proceeded to the shoe department where he put a pair of boots or and left his shoes. McDaniel stated he then followed Riggs outside and Riggs passed ail the checkout counters without paying for the merchandise. He stated he next apprehended Riggs and called SPD. I asked for the dollar amount of the merchandise stolen and was given a receipt with $1204,88 as the total stolen. I was also shown the cart full of merchandise and observed numerous CD's, DVD's, a cell phone, 2 shirts, and a pair of boots inside.

I advised Riggs not to make any statements and he stated he wouldn't have done it If he hadn't been messed up on Vallum. I asked what happened to his face and he stated he had passed out earlier and his friends marked his face up playing a joke on him. I asked why he went out with that all over his face and he stated he had no idea It was on his face. I asked if he knew a penis was drawn on the side of his neck and he stated he did not. I asked how many Vallum he had taken and he stated 3 or 4 earlier that evening.

I asked Riggs to place his hands behind his back and handcuffed him. I placed Riggs under arrest for Grand Larceny at approximately 0133 hours. McDaniel explained to Riggs he was not allowed back on Wal-Mart property or he would be charged with
