Schreck contended that he had countered the board's statement that the Universal game was deceptive. Slot players were unable to predict their chances of winning by looking at the reel strips of a machine since Universal's competitors also used stepper motors, which permit more software stops on a 22-symbol reel. Further, he said, other companies were able to show more symbols in the pay line window than would naturally appear mathematically by clustering blanks around the symbols.

Besides, Schreck said, the board's gaming lab had at one time verbally approved a competitor's machine that clustered nine blanks in front of and nine blanks behind a jackpot symbol on a reel but withdrew the approval after Universal pointed out the clustering was the same as Universal's computerized near-miss feature. That proved “there is no standard at the lab; it's just what they determine,” the lawyer said.
