VI. – « Liberté, Égalité, Fraternité »
La devise de la République (confirmée par l’article 2 de la Constitution de 1958) exprime trois droits fondamentaux que leur importance nous incite à isoler des autres.
1. La liberté est pour le droit public un principe plastique. Selon les lieux et les époques, ses règles ont pu admettre la soumission de sujets à un monarque absolu, la religion d’État imposée à tous, l’esclavage, le colonialisme, le totalitarisme…, avant de les rejeter. De manière générale, les xixe et xxe siècles ont donné à la liberté une ampleur sans cesse plus grande.
