5The legal contours of the data economy

There has been increasing interest in the legal protection offered to individuals and private entities when data becomes an integral feature of transactions, economic or otherwise, between and among participants in the data economy. There are important privacy trade-offs when personal data is aggregated and analysed together with the data of other consumers.1 This also raises issues on whether individuals are willingly providing their personal data or are being pressured to do so on the premise that other services will be made available to them if they do so or that the services they want will not otherwise be forthcoming. The legal structure of privacy protection attempts to provide some guidance on how these features should be perceived and how the attendant trade-offs should be addressed. This chapter draws on the various privacy issues that have arisen in the case study, with a focus largely on Singapore.
