Understanding UK Registered Design

A registered design automatically gives you a monopoly on the rights to use that design.

The design may be:

The shape of a product: a new leg for a table or chair.

The decoration applied to a product: a flowering rose applied to pieces of crockery.

Both the shape and the decoration of a product: the shape of a teapot which may also have a specific pattern.

The specific pattern itself, such as a floral pattern, is protected, no matter what product is named in the application form. Therefore, if somebody uses your protected floral pattern on their own product(s), they’re infringing your rights.

You can protect an entire product or just part of that product’s features as in the following examples.

Lines: the outline in plan of a roof tile.

Contours: the undulating upper surface of a bold roll roof tile.

Colours: the colours for a new pattern to be applied to a fabric for a range of furniture.

Shape: the shape of a vacuum flask.

Texture or materials: the fabrics chosen for a range of luggage.
