18th Century Graffiti: “Damn John Jay!”

In Boston—the city which the British entered at the start of the American Revolution—emotions were still brittle toward the English who had slaughtered so many of their men. Someone actually scribbled on a fence,

“Damn John Jay! Damn everyone who won’t damn John Jay! Damn everyone that won’t put lights in his windows and sit up all night damning John Jay!”

Madison was very vocal in his opposition to this treaty that the Senate passed nearly in secret. Washington brashly told Madison, “The nature of foreign negotiations requires caution, and their success must often depend on secrecy.” He then schooled Madison by adding, “The power of making treaties lies in the President, with the advice and consent of the Senate.”

Consequently, Madison’s only tool would be for the House to deny funding for the treaty implementation and enforcement. In 1796, the House of Representatives finally appropriated funds for the treaty. James Madison didn’t give up, however. He then drafted legislation asserting that the House had a right to review treaties. Due to the appeals of Fisher Ames, the congressional representative from Massachusetts, Madison’s motion failed. That was most unfortunate because the Jay Treaty came back to haunt Madison during his later presidency.
