The TRIAL of ANDREW WARNER

Proceedings of a court martial held by order of His Excellency Governor Ainslie on the 9th day of April 1814 during martial law for the trial of such prisoners as may be brought before themselves.

President, Lieut Col Armatrading, Royal St George’s; Captain Bevis, Royal St George’s, Captain Grano, St Luke’s; Lieutenant Holmes, St George’s, Lieutenant Court, St George’s, Lieutenant Watson, St Paul’s; Ensign Gloster, St George’s.

ANDREW WARNER charged with holding intercourse with the runaways to which the prisoner pleaded not guilty.

Shaw, belonging to Hillsborough estate, being sworn knows the prisoner who lives at old Warner’s estate. The prisoner gave the gun (now produced) to a Negro belonging to Hillsborough estate named Abraham, a runaway Negro now in the woods. He, the witness and Abraham were in the camp together, Abraham gave the prisoner plantains in exchange for the gun. He carried him plantains four times, that he saw him carry the plantains, that Abraham brought the gun into the camp and told him he had brought it from Andrew, that he never saw the gun in the possession of the prisoner, that he has once been on Mt George estate, that he never saw the gun in the prisoner’s possession but Abraham told him that the gun was Andrew’s, that he once went to Andrew’s house, that he never saw the gun in his house but he once brought plantains, Andrew gave him nothing, that he has seen the gun in the hands of the prisoner. He was not there when he sold the gun, that he has been in the prisoner’s house three times since he ran away, he carried plantains the times he went, that he gave them to the prisoner and he in return gave him a glass of rum and salt to carry with them, that he never gave him anything else, that he was not there when the gun was sold, that he gave a man named Ochra, a runaway, tobacco to give to Abraham, that he saw him give the man the tobacco and at the same time told him not to let the Negroes see him.

Q Did you ever see Andrew give powder?

A No I never did.

Q Did you ever see him give anything else?

A No.

He never saw the prisoner sell cutlasses but was present and saw him put a handle to a cutlass which he gave to a man of the name of Cuffy to give to Abraham.

That Andrew, the prisoner, and the others who came with him were runaways, that salt he gave them was for Abraham, that Abraham otherwise called John is a chief, that he only gave them salt once. The prisoner being asked if he had questions to ask:

Q Were you present when I put the handle on the cutlass?

A No I was not. I was present when Cuffy gave the cutlass to Andrew from Abraham and begged him to put a handle on the same, when they returned he gave the cutlass to Cuffy.
