“MOTHERS DON’T LIE. BRATZ was born on an August evening in Kimberling City,” Thomas Nolan, MGA’s attorney, told the jury. After weeks of testimony by Mattel and MGA employees and industry experts, beginning in May 2008, Carter Bryant’s mother, Jane, took the stand to testify that Carter was inspired to create Bratz while living with her in Missouri. This timeline was intended to show that Carter was not a Mattel employee when he invented the dolls. Mattel’s ownership claim over the Bratz empire hinged entirely on its argument that Carter had secretly created Bratz while he was being paid to design Barbie’s wardrobe. If the jury was persuaded by the Bryants instead, then Mattel couldn’t touch the Bratz product line. Carter’s employment contract—assigning all his creativity to the company—was inapplicable to his time away from the company.
