Format for Briefing a Case

A legal brief can be a concise or an extensive set of notes depending on the reason for researching a case. A standard legal brief should be no shorter than half a page, and no longer than a full single-spaced page of text. Here are some simple guidelines for briefing a case:

1.

State the name of the case.

2.

State the full citation: volume of the U.S. Reports, the page number, and the year.

3.

Identify the important facts in the case—describe objectively what happened to whom.

4.

Identify the issue—what were parties disagreeing about?

5.

State the decision (holding)—find out who won.

6.

List the vote margin—how many voted yes and how many voted no.

7.

Identify the reasons stated by the majority of the court for the decision.

8.

Identify particular reasons given by individual judges for their concurring votes.

9.

Identify particular reasons given by individual judges for their dissenting votes.

10.

Identify and summarize the rule of law or outcome.

11.

Identify and evaluate the importance of the case to your research or
