Multiple-Principle Theory

The problem we have noted concerns the requirement that political obligations be “comprehensive,” that a theory establish moral requirements to obey all laws passed by the state. Closely related is the idea of “content-independence,” that laws bind because of their provenance rather than their content. If the only laws that citizens must obey concern the provision of essential public goods, then this feature of political obligations too is lost. In addition, content-independence is linked to the “self-image of the state,” according to which the state is able to pass laws on any subject, thereby obligating citizens to obey. This too is not realized if the state is able to bind subjects only to the provision of essential public goods. Can the principle of fair play establish a successful theory if it is not able to move beyond these difficulties?
