The interests of justice should include an interest in avoiding damage to a peacemaking or peace-implementation process that is real, concrete, and making progress—and that includes a credible justice component.

In some cases, such as Uganda in mid- to late 2005, plans for peace talks were quietly under way, and Ugandan community leaders urged the prosecutor to hold off on any arrest warrants. These pleas were apparently ignored; warrants were released by the ICC not long after a group of community leaders visited The Hague to urge the prosecutors to hold off. In other cases, as in Colombia, the ICC has actively monitored the state of law and national prosecutions while peace negotiations were under way; while this was generally welcomed, many Colombians (and international experts) felt the ICC went too far when it intervened in—and apparently directly influenced—the Colombian Constitutional Court in relation to its decision on an alternative justice legal framework. In cases where a broad range of national actors, including human rights advocates, are urging that a peace process be given breathing space and for international justice to be temporarily quiet or held at bay, this should be taken into consideration.
