The General Contractor’s Contract

A contract between the customer and the general contractor should cover the following topics. Be sure to review each of them with an attorney, as they may provide you with some additional protection.

CONTRACT CONTINGENCIES, CANCELLATION, AND AUTHORIZATION TO BUILD

You might want to commit to a GC even before you know for sure you can build your new home. This would be true if you first have to sell your existing home, obtain financing, purchase a building lot, or obtain a building permit and all requisite approvals (board of health, planning board, zoning board). In this case, your attorney should add contract language that allows you to get started with the preliminary steps without committing you to building the home until you have resolved any contingencies specified in the contract. The clause should state how much money the GC will keep if you are unable to meet all of the contingencies and so are forced to cancel. The contract should also create a mechanism that tells the GC when you would like him to begin. If you have added contingencies to your contract, this mechanism will also indicate that you have either met or waived your contigencies so that you can no longer cancel the contract.
